Terms of Use

• You must be at least 18 to create an account. Use your own, accurate information and don't share your account.
• Your household is your family on Gatherings. You may add your own children to it, and you confirm you're their parent or legal guardian (or have that person's permission).
• Children under 13 never get their own account; they appear only as a first name and birth year on a parent's household. Teens aged 13 to 17 may use the Service only through an account a parent or guardian creates and supervises, when that feature is offered.
• You're responsible for what happens under your account. Tell us right away at info@gatherings.school if you think someone has used it without permission.

Each Gathering has an Owner and may have Admins and Leaders. They decide who joins, approve or remove families, assign roles and set the Gathering's rules. The Owner and Admins of a Gathering are responsible for running it and for how it uses the Service.

Jenisan does not screen, vet or background-check any group, member, teacher or volunteer. Gatherings are independent community groups. Decide for yourself, and for your children, which groups to join and whom to trust.

Gatherings helps groups plan co-op days, classes, field trips and other activities, but Jenisan doesn't organize, host, supervise or attend them. Each Gathering and the families who take part are responsible for the safety, supervision, permissions, waivers and insurance for their own activities. To the fullest extent the law allows, Jenisan isn't responsible for anything that happens at or because of an activity arranged through the Service, or for the conduct of any member, online or offline.

You own the posts, messages, photos, files and other information you put into the Service (“Your Content”). You give us permission to host, copy, process and display Your Content only as needed to run the Service, which includes showing it to the members of the Gatherings and Circles you share it with.

You're responsible for Your Content and for having the right to share it. Only share photos or information about another family's children with their parent's permission.

Don't use the Service to:

• harm, exploit, threaten or harass anyone, especially children;
• contact a child through the Service against their parent's wishes, or try to get a child's contact information;
• break the law or infringe anyone's rights, including privacy and intellectual property rights;
• pretend to be someone else or misrepresent your connection to a family or group;
• send spam or unwanted messages, or upload malware;
• try to get into accounts, Gatherings or information you aren't allowed to see, or test or bypass our security;
• overload, disrupt or reverse engineer the Service, or scrape it with automated tools.

We may remove content, suspend Gatherings or suspend accounts that break these rules, and we'll tell you when we reasonably can. We may report suspected harm to children to the authorities.

Gatherings' community features are free. We may later offer paid features, such as class registration and payments for groups. Before anything costs money, the price, billing period and renewal terms will be shown, and you'll choose whether to subscribe. Fees are non-refundable except where the law requires otherwise.

The Service relies on providers such as Supabase, Vercel and Resend. If you use another service through Gatherings, that service's own terms apply to it, and we aren't responsible for it.

The Service, its software, design and the Gatherings and Jenisan names and logos belong to Jenisan, Inc. These Terms don't give you any rights to them beyond using the Service. If you send us feedback or suggestions, we may use them without any obligation to you.

You can stop using the Service at any time, and you can ask us to remove your household from a Gathering or to delete your account and household. A Gathering's Owner can ask us to delete the Gathering. We may suspend or end access if you break these Terms, if required by law, or if we stop offering the Service, with reasonable notice where possible so you can save what you need.

We work hard to keep Gatherings reliable, but the Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted or error-free, or that messages and emails will always be delivered. Keep your own copies of anything important.

To the fullest extent the law allows, Jenisan and its officers, employees and suppliers won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service or from any activity arranged through it. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or US $100. Some places don't allow these limits, so they may not fully apply to you.

You'll defend and hold harmless Jenisan from claims, losses and costs (including reasonable legal fees) arising from Your Content, a Gathering you run, activities you organize, or your breach of these Terms or the law.

These Terms are governed by the laws of the State of Arizona and applicable US federal law, without regard to conflict-of-law rules. Any dispute that isn't resolved informally will be brought only in the state or federal courts located in Maricopa County, Arizona, and you and we consent to their jurisdiction. Either party may bring an eligible claim in small claims court instead.

To the fullest extent the law allows, claims may be brought only on an individual basis, not as a plaintiff or class member in a class, collective or representative action.

• Changes: we may update these Terms. For significant changes, we'll notify account holders by email or in the app at least 30 days before they take effect. Continuing to use the Service after that means you accept the new Terms.
• Whole agreement: these Terms and the Privacy Policy are the entire agreement between you and us about the Service.
• Severability: if any part is found unenforceable, the rest stays in effect.
• No waiver: not enforcing a term right away doesn't mean we give it up.
• Assignment: you can't transfer these Terms without our consent; we may transfer them as part of a merger, sale or reorganization.
• Events beyond control: neither of us is responsible for delays caused by things outside reasonable control, such as outages of providers we rely on.
